NJJN calls on the states to ensure that all our children have the protection of a reasonable minimum age of prosecution when in conflict with the law, a human right included in the Convention on the Rights of the Child (CRC). The most common minimum age internationally is 14, which is consistent with scientific evidence on brain development and with the minimum age recommended by the CRC.

This year has been one of the most tumultuous in recent history as we continue to deal with the twin scourges of a pandemic continuing to rage out of control and outrage over police brutality and killings of BIPOC individuals, as evidenced by the George Floyd case and far too many others. The year has now been capped off by a presidential election that has also been one of the most tumultuous in recent history with President Trump continuing to dispute the results and sow doubt regarding the integrity of our election systems throughout the country and the validity of the results. So where do we go from here? We are at a pivotal time in history when the blinders have been ripped off for many revealing the underbelly of racism permeating our youth justice system. While we have our work cut out for us, we also have an opportunity with the Biden/Harris Administration to move boldly forward in advocating for an agenda to push for transformative changes to the youth justice system. There are some of the key areas to seek change at the federal level.

FEDERAL POLICY PRIORITIES, 7.9.20 (final)

In the last six months the twin scourges of the novel coronavirus pandemic and racist police brutality have hit our country hard. Police shootings of people of color, unfortunately, are not a new occurrence; youth of color are killed by police far out of proportion to white youth. In 2019, 56% of youth killed by police were Black or Hispanic (10 out of 14; 2 were white, 1 other, and 1 unknown). Although Black Americans account for less than 13% of the U.S. population, they are killed by police at more than twice the rate of white Americans. Hispanic Americans are also killed by police at a disproportionate rate. Nationally, police have shot and killed approximately 1,000 people each year since 2015 when the Washington Post began collecting the data (there is no nationwide government data collection). But the size and scope of the protests since George Floyd's death are a hopeful sign that transformative change is coming. While Congress has finally made some attempts to address this problem, it does not go far enough and we must press them to go further.

US District Court Decision: City of Los Angeles vs. Sessions

The Federal Department of Justice has continued to try to tie federal funding for state law enforcement programs to collaboration with immigration enforcement. These efforts have repeatedly been struck down by the courts as unconstitutional. The latest court decision, out of the US District Court in California, emerges from a lawsuit filed by the Los Angeles Police Department over the conditions in the 2018 Byrne JAG grant solicitation (Los Angeles v. Sessions). The Court’s decision, issued on February 15, 2019, ordered that the DOJ is permanently enjoined (program wide) from requiring collaboration with immigration enforcement -- (notice and access; 8 U.S.C. § 1373 and 1644; 1324 harboring/non-disclosure; and the questionnaire/8 U.S.C. § 1366 certification). Notably, the Court also enjoined similar conditions, specifically a preference given to applicants who indicated they would cooperate with immigration enforcement, from being imposed on awards under OJJDP's FY 2018 Gang Suppression Planning Grants Program.

The NCSL Juvenile Justice Principles Work Group project was developed under an NCSL partnership with The Pew Charitable Trusts public safety performance project. The work group project responds to the challenge lawmakers face of constructing juvenile justice systems that are both fiscally responsible and improve outcomes on many important fronts: protecting and enhancing public safety, holding youth accountable, helping youth develop the skills they need to succeed, preserving and strengthening families, and promoting fairness. The issues addressed in these Principles reflect the important role of state legislatures in enacting policies that avoid unnecessary involvement of youth in the justice system and support evidence-based interventions that reduce recidivism and protect public safety. While working group members and other lawmakers recognize that confinement may be necessary for youth who commit the most serious crimes and pose the greatest threat to public safety, a major interest of the group was sustaining and reinforcing the current trends of falling juvenile crime and out-of-home placement rates.

This Toolkit was prepared by the Council of Juvenile Correctional Administrators (CJCA) with additional support from The Pew Charitable Trusts. Many agencies across the country are closing facilities. CJCA members have been informally helping each other through this process and wanted to collect their experiences, resources and advice in one document. In addition to juvenile justice administrators and agency staff, the information here may be useful to legislators, court officers and administrators, leaders of related agencies (e.g., education, health), advocates, and others who may be engaged in the closure process and/or supporting youth and families. This guide is intended to help juvenile justice agencies responsibly and successfully close a facility and consider closure as a component of efforts to safely reduce the use of juvenile justice placement facilities. It also shows how best to manage those closures when they occur, as well as how to redirect facility operational funds to other parts of the system, such as community‐based diversion and/or aftercare services.

The report documents the scope and impact of violence and abuse on women and girls and highlights gender-responsive, trauma-informed approaches that more than three dozen federal agencies, departments, and offices have implemented. A Multi-State Recidivism Study Using Static-99R and Static-2002 Risk Scores and Tier Guidelines from the Adam Walsh Act

This study seeks to examine important components of our nation’s sex offender tracking and monitoring systems, with a focus on risk assessment and sexual recidivism (measured by re-arrest). On average, we found that the recidivism rate was approximately 5% at five years and 10% at 10 years. AWA tier was unrelated to sexual recidivism. The findings indicate that the current AWA classification scheme is likely to result in a system that is less effective in protecting the public than the classification systems currently implemented in the states studied.

Adam Walsh Act Update: State Resistance to Comply and Federal Leniency in Compliance Review

Update noting that states are resistant to comply with the Adam Walsh Act, due to the high expense of compliance, the negative public safety and rehabilitation effects of placing youth on registries, and confidence in their own current state laws, many of which have been carefully crafted to assess for actual risk, rather than acting as more blunt offense-based tools. Additionally, the federal SMART (Sex Offender Sentencing, Monitoring, Apprehending, Registering, and Tracking) office modified the law's guidelines, allowing jurisdictions to exempt youthful offenders from public registries, and place them on private, law enforcement-only registries. In doing so, the SMART office has allowed for a more lenient definition of "substantial implementation" than it indicated it would in the past.

The opinion stated that “a child’s age is far ‘more than a chronological fact’” and that “it is beyond dispute that children will often feel bound to submit to police questioning when an adult in the same circumstances would feel free to leave. Seeing no reason for police officers or courts to blind themselves to that commonsense reality, we hold that a child’s age properly informs the Miranda custody analysis.”

In September 2009, a panel of the federal Ninth Circuit Court of Appeals ruled that that the retroactive application of the Sex Offender Registration and Notification Act’s (SORNA) provisions for former youth offenders is punitive and in violation of the Ex Post Facto Clause of the U.S. Constitution. The court found that the registration and reporting requirements would affect many adults who were sentenced for sex offenses many years ago when they were youth, and that the requirements threaten “to disrupt the stability of [individuals’] lives and to ostracize them from their communities by drawing attention to decades-old sex offenses committed as juveniles that have, until now, remained sealed.” The court referred to the “pervasive and severe” disadvantages of mandatory registration and the historic confidentiality of juvenile proceedings in its reasoning.
